Employment Discrimination Lawsuits on the Rise

According to a study by the U.S. Administrative Office of the Courts, the number of employment discrimination lawsuits filed in federal court nationwide has more than doubled since 1992. A recent Washington Post article reporting on the study (Kirsten Downey Grimsley, “New Laws Boost Hopes for Monetary Awards,” May 12, 1996, at A1) attributes the increase to the passage of the Civil Rights Act of 1991, which for the first time allowed punitive damages and attorney’s fees in many employment discrimination cases, as well as to the passage of the Americans with Disabilities Act and an increased consciousness of sexual harassment and other gender issues growing out of the confirmation hearings of Supreme Court Justice Clarence Thomas. This trend shows no sign of abating.
